Rental Contract

Dear Guest ~

Thank you very much for staying with Hickory Mist Luxury Cabin Rentals. We look forward to having you as our guest. Please read this confirmation carefully, and call us right away if there are any discrepancies.

You should find your unit fully stocked with linens, paper products, and soaps. Our units are each privately owned, and we ask that you treat their property kindly.  Be sure to let the office know immediately upon check-in if anything in your unit needs attention. You will be held responsible for any unreported items!

Check-in is subject to unit cleaning, and is between 4:00pm and 8:00pm. If you are going to be checking in later than 8:00 pm, please call the office in advance so that we may give you late arrival instructions. At check-in, you must pay any remaining balance due on your reservation. Personal Checks are NOT accepted at check-in. Cash, Travelers Cheques, Visa, Master Card, Discover, and American Express are accepted forms of payment. Please note no portion of your deposit will be held in Escrow, as subject to Tennessee State Code Annotated 62-13-104 7 (D) (i). If any monies are held in escrow they will accrue interest and all proceeds from that interest will be payable to Hickory Mist Luxury Cabin Rentals, LLC only.

Cancellations (or rescheduling of your visit) are subject to a cancellation and processing fee, and must be made a minimum of 30 days prior to your arrival. If you cancel inside 30 days from arrival, you will lose your deposit. A damage deposit may be required at check-in. The amount of the deposit will vary according to the size and classification of the cabin, and is payable with credit card or cash. Cash deposits will be refunded by check within 2 weeks of check out.

VERY IMPORTANT! Hickory Mist Luxury Cabin Rentals cannot refund any amount of your stay for circumstances outside of our control. Including, Acts of God, severe or inclement weather, failure of public utilities, mechanical failures, and so forth. Please make arrangements for your safe transportation in the event of bad weather.  These are the mountains, and the roads can be snow covered in the winter months.  Feel free to call the office for anything regarding your reservation, and don't forget to have your confirmation number handy (located in the upper right-hand corner).

PLEASE NOTE! We use only the finest linens in our cabins for your stay. Due to the high expense involved in offering such a service, there will be a $200 fee for lost, damaged, or stolen bed linen, and a $100 fee for any lost, damaged or stolen towels of any kind. NO EXCEPTIONS. There is a $300 additional cleaning fee for smoking in a non-smoking cabin, or if evidence of a pet is found in a No-Pet cabin. This is to protect our guests and owners with allergies, and to offset costs of potential damages to the property. Airsoft Guns are prohibited in ALL of our properties, any evidence of the use of an Airsoft gun will result in penalties up to $300.00 and not less than $100.00. Additionally, any damage caused by said Airsoft guns will be the full responsiblity of the guest listed on the confirmation.

IMPORTANT! All amenities quoted by Hickory Mist Luxury Cabin Rentals, LLC on both the website and in any and all advertisement is accurate at time of property listing and no guarantees of accuracy may be held liable to Hickory Mist Luxury Cabin Rentals, LLC. Wireless internet service is considered an OUTSIDE AMENITY and NOT in our control, no guarantees NOR REFUNDS will be given for lack of Internet Access or Service. Hickory Mist Luxury Cabin Rentals, LLC reserves the right to change or modify your reservation based on property availability and cannot guarantee property availability due to acts of cabin ownership or acts of God.

All units have specific cleaning fees and a $35 processing fee will be charged.

The Hickory Mist Management and Staff welcome you to the beautiful Smoky Mountains! Please note the following. Our cabins are privately owned and we ask that you treat their cabins and chalets just as you would like someone to treat yours.

A NON-REFUNDABLE RESERVATION PROCESSING FEE OF $35 AND THE APPROPRIATE DEPOSIT ARE REQUIRED FOR EACH RESERVATION TO CONFIRM YOUR RENTAL. The full rent is due upon arrival with the deposit; your credit card number will serve as a damage deposit during your stay. Any damage WILL be charged to your card. Any deposits are considered to available funds to Hickory Mist Luxury Cabin Rentals, and no portion of those deposits will be held in Escrow, subject to Tennessee State Code Annotated 62-13-104 7 (D) (i). If any monies are held in escrow they will accrue interest which is payable to Hickory Mist Luxury Cabin Rentals, LLC only.

MANAGEMENT ASKS THAT YOU PLEASE NOTE THE FOLLOWING TERMS:

GUEST RENTALS AGREEMENT

1.  Check-in is from 4:00 p.m. to 8:00 p.m. NO CHECK-INS AFTER 10:00 P.M. WITHOUT PRIOR APPROVAL. CHECK-OUT TIME IS 11:00 A.M. Late departures WILL incur an additional night charged to your credit card. NO REFUNDS FOR EARLY DEPARTURES.

2.  Cancellations will be accepted and deposits refunded (less $35.00 processing fee), if rental office is notified 30 days prior to arrival. A "NO SHOW" IS AN AUTOMATIC FORFEITURE OF DEPOSIT.

3.  All units are privately owned and we reserve the right to refuse service to anyone. TEENAGERS AND YOUNG ADULTS MUST BE ACCOMPANIED BY A PARENT.

No cabin may exceed the legal occupancy limits.

4.  RENTER AGREES TO INDEMNIFY OWNER OF ANY DAMAGES TO THE PREMISES (INCLUDING FURNISHINGS AND HOUSEHOLD ITEMS) WHICH RESULTS FROM THE RENTERS OCCUPANCY. IN THE EVENT DAMAGES OCCUR THE AMOUNT OF DAMAGE SHALL BECOME PAYABLE BY THE TENANT AND AUTOMATICALLY CHARGED TO THE CREDIT CARD ON FILE.  WE WILL NOT BE RESPONSIBLE FOR ACCIDENTS OR INJURY TO GUEST OR FOR LOSS OF MONEY OR VALUABLES OF ANY KIND.

5.  A maid service / linen fee will be charged with all units. Your unit is completely furnished including kitchen utensils and flatware. Linens, towels, bathroom tissue and soap are placed in your unit prior to your arrival. This will not be replaced during your stay unless additional maid service is requested and paid for. Washers and dryers are in most units for your convenience. Any lost, damaged or stolen linens are subject to a $200 replacement fee, any lost, damaged, or stolen towels of ANY size are subject to a $100 replacement fee.

6.  Credit Cards - we accept Visa, MasterCard, AMEX and Discover cards. Personal checks must arrive 30 days prior to your arrival, cash may be used but an additional card security deposit may be required.

7.  All rentals have telephones, for local calls only. Calling cards may be necessary for long distance calling.

8   FIRE CODES PREVENT OUR ISSUING MATCHES, LIGHTERS, OR KINDLING TO GUESTS DURING THEIR STAY. PLEASE WATCH GRILLS CAREFULLY!

9.  PETS ARE NOT ALLOWED. (Except in Pet Friendly Units) For the protection of the owners, this policy will be strictly enforced. We reserve the right to cancel reservations and/or occupancy of rental units plus charge a minimum $300 fee for treatment of fleas, and to clean the cabin. In pet friendly units a non-refundable $75 fee will be charged.

10. SMOKING IN A NON-SMOKING CABIN IS SUBJECT TO A MINIMUM FINE OF $300, NO EXCEPTIONS!

11. AIRSOFT GUNS ARE STRICTLY BANNED AT ALL OF OUR RENTAL PROPERTIES! ANY EVIDENCE OF THEIR USE WITHIN ONE OF OUR PROPERTIES WILL RESULT IN A PENALTY OF AT LEAST $300 BUT NOT LESS THAN $100, NO EXCEPTIONS!

12.  We make every effort to keep each property and its equipment in good working order. We will strive to make any repairs as soon as possible. We cannot guarantee A/C's, TV's, appliances, etc. NO REFUNDS OR RATE ADJUSTMENTS WILL BE MADE FOR MECHANICAL FAILURES.

13. IMPORTANT! 14.  NO REFUNDS FOR BAD WEATHER, ACTS OF GOD, ETC. While we will work to assist you in moving your dates, THERE ARE NO REFUNDS!

15. Parties, disrespectful behavior, or vilolations of the law are UNACCEPTABLE and will result in your removal from the property.

16. All units have specific cleaning fees and a $35 processing fee will be charged.

17.  Renters certify that they have read the above agreement and agree to abide by all posted regulations, including house rules.

18. NOTICE! Prior to your departure, please confirm all soiled towels are left in one bathroom's tub, and that all dishes are returned to the kitchen area and washed! If your cabin, and/or party, is large, you may need to run more than one load. Failure to follow this procedure could incur additional cleaning charges to your stay. These charges WILL be charged against the credit card on file with the reservation. No exceptions may be made due to interaction with Hickory Mist staff, this agreement will supercede any and all verbal or written agreements.
